Force Majeure

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.

Waiver

Failure of either Party to insist upon strict performance of any provision of this or any Agreement or the failure of either Party to exercise any right or remedy to which it, he or they are entitled hereunder shall not constitute a waiver thereof and shall not cause a diminution of the obligations under this or any Agreement. No waiver of any of the provisions of this or any Agreement shall be effective unless it is expressly stated to be such and signed by both Parties.

General

The laws of the Commonwealth of Pennsylvania govern these terms and conditions. By accessing this website and using our services/buying our products you consent to these terms and conditions and to the exclusive jurisdiction of the courts in all disputes arising out of such access. If any of these terms are deemed invalid or unenforceable for any reason (including, but not limited to the exclusions and limitations set out above), then the invalid or unenforceable provision will be severed from these terms and the remaining terms will continue to apply. Failure of the Company to enforce any of the provisions set out in these Terms and Conditions and any Agreement, or failure to exercise any option to terminate, shall not be construed as waiver of such provisions and shall not affect the validity of these Terms and Conditions or of any Agreement or any part thereof, or the right thereafter to enforce each and every provision. These Terms and Conditions shall not be amended, modified, varied or supplemented except in writing and signed by duly authorized representatives of the Company.

Notification of Changes

The Company reserves the right to change these conditions from time to time as it sees fit and your continued use of the site will signify your acceptance of any adjustment to these terms. If there are any changes to our privacy policy, we will announce that these changes have been made on our home page and on other key pages on our site. If there are any changes in how we use our site customers? Personally Identifiable Information, notification by e-mail or postal mail will be made to those affected by this change. Any changes to our privacy policy will be posted on our web site 30 days prior to these changes taking place. You are therefore advised to re-read this statement on a regular basis

Distribution Rights

All Green Lighting LED distributors acknowledge that any and all agreement rights has been made in the State of Pennsylvania and shall be governed and construed in a accordance with the laws of Pennsylvania. Any controversy or claim arising out of or relating to any and all Agreement or the breach of Agreement shall be settled by arbitration at the offices of the Company in accordance with the then-existing rules of the American Arbitration Association. All communications, notices and demands of any kind which either party may be required or may desire to give or serve upon the other party shall be made in writing and delivered by first class certified mail, postage prepaid, return receipt requested. Any and all agreements to have legal validation must be signed by both parties.? Email or verbal correspondence will not suffice as a substitute in any and all cases.

WARRANTY AGREEMENT

LED Light Products.

LED Light Products sold by Green Lighting LED™

Green Lighting LED™ passes on a manufacturing warranty on product to be free from defects in material and workmanship for a period of 1-3 years, starting from the date of delivery. The time period depends on the manufacturer. Manufacturer warrants that all LEDs provided will be new and in best functioning condition. If you discover a defect in a product covered by this warranty, we will repair it. If the repair is not possible, we will replace the item.

Exclusions:

This warranty covers defects in manufacturing discovered while using the product as recommended by the manufacturer. The warranty does not cover loss or theft, nor does coverage extend to damage caused by misuse, abuse (this includes mechanical shocks), unauthorized modification, improper storage conditions, lightning or natural disasters. Green Lighting LED™ does not warrant its products compatibility with incandescent dimming systems.

Limits of Liability:

Should the product(s) fail, your sole recourse shall be repair or replacement, as described above. Green Lighting LED™ will not be held liable to you or any other party for any damages that result from the failure of this product. Damages excluded include, but are not limited to, the following: lost profits, lost savings, lost data, damage to other equipment, and incidental or consequential damages arising from the use, or inability to use this product.

In no event will Green Lighting LED™ be liable for more than the amount of your purchase price, not to exceed the current list price of the product, and excluding tax, shipping and handling charges. By installing or using the product, the user accepts all terms described herein.? Green Lighting LED™ is not liable and the full warranty is under the discretion of the manufacturer.

How to Obtain Service Under This Warranty:

Send the damaged product, the invoice and this warranty to Green Lighting LED™.

Contact us at (814) 897-8870. The costs of shipping to the retailer or payment of any customs clearance fees or duties are the responsibility of the buyer.

Exchange Policy:

Green Lighting LED™ does not accept returns and has a 10 day exchange policy from date of delivery. All items returns are subject to a restocking charge of 20% and return shipping fees are the responsibility of the customer. The customer is fully liable for any product damaged during returned shipping. Special designs, beam angles, color temperatures and voltages are not returnable, refundable and cannot be exchanged. All exchanges must have a valid invoice to be approved.

All customers are encouraged to order samples prior to placing a full order to ensure the product being ordered is correct. Final approval for any exchange is the sole discretion of Green Lighting LED™ and exchanges can be rejected even if filed within the 10 day period.
